El Salón de Actos del ICAM se llenó ayer de colegiados/as en la reinauguración de la Sección de UE e Internacional que, en esta nueva etapa, contará con la presidencia de Juan Ignacio Signes y Enrique Braquehais.

El acto contó con la presencia del Decano, Eugenio Ribón, de los Diputados José Ramón Couso y Teresa Mínguez -encargada de inaugurar la sesión-, así como de destacadas autoridades del ámbito jurídico como el magistrado Manuel Marchena, o el presidente de la Sección de Derecho Constitucional y Parlamentario, Ignacio Ulloa.

La Diputada de la Junta de Gobierno del ICAM, Teresa Mínguez, inauguró la jornada recordando la apuesta decidida del Colegio “por establecer un puente de comunicación entre el jurista madrileño y la esfera jurídica europea”, una apuesta que, como explicó la Diputada, se justifica por sí misma “a la luz del interesante volumen de normativa europea que día a día adoptan las instituciones de Bruselas y el cada vez mayor número de resoluciones de impacto adoptadas por los tribunales europeos desde Luxemburgo”.

En su presentación, la Diputada también avanzó los detalles de la Cumbre del Derecho de la Unión Europea que el ICAM ha organizado los próximos días 16 y 17 de noviembre en la Galería de las Colecciones Reales, animando a todos los presentes a asistir.

Los nuevos presidentes de la Sección, Juan Ignacio Signes y Enrique Braquehais, avanzaron a los presentes las iniciativas que tienen planteadas para esta nueva etapa, en la que continuarán con su labor de aproximar el ordenamiento jurídico de la Unión a los miembros del ICAM, así como de familiarizarles con la práctica que acontece en el seno de las instituciones europeas.

Asimismo, destacaron que la finalidad de la Sección es convertirse en foro de discusión para los abogados madrileños sobre las múltiples materias que, en la actualidad, comprende el Derecho europeo, y pusieron en valor la calidad y experiencia de los miembros del Consejo Asesor.

Tras la presentación, tuvo lugar una sesión sobre «La Unión Europea como Unión de Derecho para el justiciable» en la que intervinieron Cani Fernández, Presidenta de la Comisión Nacional de los Mercados y la Competencia, y Rafael García-Valdecasas, antiguo miembro español del Tribunal General de la UE.

Rafael García-Valdecasas expuso las razones que justifican la existencia de una Sección de Derecho de la UE basándose en el papel que juega el Derecho de la Unión y el TJUE en la vida de los ciudadanos y recordó que TJUE trabaja para garantizar la imparcialidad de la justicia europea.

Por su parte, Cani Fernández, habló de los reglamentos y regulación comunitaria recordando que aunque la Comisión Europea es supervisora de la ejecución de la regulación comunitaria, son los propios Estados quienes transponen las directivas. En este sentido, Fernández incidió en que en las nuevas aplicaciones normativas hay un modelo de aplicación centralizada con cooperación de todas las autoridades nacionales.

Juan Ignacio Signes de Mesa es Letrado del Tribunal de Justicia de la Unión Europea. Licenciado y doctor por la Universidad Complutense de Madrid, es igualmente graduado del Colegio de Europa y la Harvard Law School. Es miembro del claustro de profesores de varios programas de postgrado, en particular en el Colegio de Europa (Campus Brujas), la Universidad Carlos III y la Universidad Pontificia Comillas–ICADE. Dirige a su vez varios seminarios y encuentros académicos en el seno de la Academia de Práctica Jurídica Europea (APJE) y la School of Transnational Governance–Instituto Universitario Europeo (IUE), así como en los programas de verano de la Universidad Internacional Menéndez Pelayo (UIMP–Palacio de La Magdalena) y la Universidad del País Vasco (UPV–Palacio de Miramar). Es miembro (no ejerciente) tanto del New York Bar como del Ilustre Colegio de la Abogacía de Madrid. Es académico correspondiente de la Real Academia de Jurisprudencia y Legislación.

Enrique Braquehais es actualmente el Abogado del Estado-Jefe en la Agencia Estatal de la Administración Tributaria en Baleares. Entre otras responsabilidades profesionales ha sido Agente del Reino de España ante el Tribunal de Justicia de la Unión Europea y Abogado del Estado en la Secretaría de Estado para la Unión Europea, del Ministerio de Asuntos Exteriores, Unión Europea y Cooperación, periodo durante el cual fue condecorado con la Cruz de Oficial de la Orden del Mérito Civil.

Es graduado por Stanford Business School (SEP). Ha cursado posgrados igualmente en Harvard Business School e IESE. Fue Director y profesor del Programa «El procedimiento ante los tribunales comunitarios» en el Instituto de Empresa. Ha sido ponente sobre Derecho de la Unión Europea en la Escuela Diplomática, de Derecho Administrativo en Esade y de Derecho tributario en el Instituto de Estudios Fiscales. Igualmente está condecorado con la Cruz de la Orden al Mérito Policial.
