La Sección de Derecho Sanitario del ICAM profundiza en el derecho del paciente y en el proceso de derivaciones intra e inter comunitarias en España

La Sección de Derecho Sanitario del Ilustre Colegio de la Abogacía de Madrid ha llevado a cabo una jornada titulada “Derecho del paciente a elegir dónde ser tratado por un especialista. Proceso de derivaciones intra e inter comunitarias en España: SIFCO y CSUR”. El evento, realizado en el marco de la semana de la igualdad, ha generado un importante debate en torno a los derechos fundamentales de los pacientes en el sistema sanitario español.

Bajo la dirección de la presidenta de la Sección Sanitaria del ICAM, Mª Esperanza Marcos Juárez, y el miembro del Comité Asesor de la Sección de Derecho Sanitario ICAM, Alberto López Rocha, la jornada contó con la participación de destacados expertos y profesionales del ámbito sanitario y jurídico: María Dolores Rubio y Lleonart, miembro del Observatorio Economía y Salud de la Fundación Universidad Alcalá Henares; Raquel Sánchez Sanz, abogada y miembro del Comité Asesor de la FEP; Andoni Lorenzo Garmendia, presidente del Foro Español de Pacientes; y María Rodríguez Reyes, Coordinadora de Enfermedades Raras Respiratorias de FENAER.

Durante la jornada, se destacó la importancia del derecho del paciente a elegir el centro y especialista para su tratamiento, un principio consagrado en la Ley General de Sanidad que busca garantizar la igualdad efectiva en la atención sanitaria. Se resaltó la necesidad de que los sistemas informáticos faciliten el traslado de expedientes de pacientes entre comunidades autónomas, asegurando una óptima gestión administrativa y una atención de calidad.

En este contexto, se subrayó la importancia de un acceso ágil y transparente a los servicios sanitarios, donde los pacientes tengan la posibilidad de solicitar el acceso al centro y especialidad deseada. En caso de falta de respuesta, se recalcó la opción de interponer un recurso de alzada, un trámite que, aunque muchas veces requiere la intervención de abogados, es fundamental para garantizar los derechos de los pacientes en materia de salud.
