El ICAM acoge la presentación de la 3ª Edición del «Comentario a la Ley Concursal»

El pasado 12 de diciembre, el Ilustre Colegio de la Abogacía de Madrid celebró una sesión organizada por la Sección de Derecho Bancario, la Sección de Reestructuraciones e Insolvencias, y la Sección de UE e Internacional del ICAM. La ocasión tuvo como objetivo principal la presentación de la tan esperada «3ª Edición del Comentario a la Ley Concursal«, de la editorial La Ley, una obra de gran relevancia dirigida por la destacada catedrática de Derecho Mercantil, Juana Pulgar, y coordinada por Andrés Gutiérrez Gilsanz, Javier Megías López, y Eva Recamán Graña.

La presentación, que tuvo lugar en el Salón de Actos del ICAM, contó con la participación de destacados ponentes del ámbito jurídico:

  • José Ramón Couso, Diputado 2º y presidente de la Sección de Derecho Bancario ICAM.
  • Adrián Thery, Copresidente de la Sección de Reestructuraciones, Insolvencias y Segunda Oportunidad del ICAM.
  • Jacobo Fernández Álvarez, Secretario General Técnico del Ministerio de Justicia.
  • Juana Pulgar, Catedrática de Derecho Mercantil de la UCM, Vocal de la Comisión General de Codificación y Of Counsel en Latham & Watkins.
  • Ignacio Sancho Gargallo, Magistrado de la Sala 1ª del Tribunal Supremo.

La jornada fue inaugurada por José Ramón Couso, quien destacó la importancia de la colaboración entre las Secciones para abordar temas cruciales en el ámbito legal. Adrián Thery, en su calidad de presidente de la Sección de Reestructuraciones e Insolvencias del ICAM, abordó aspectos clave de la Ley Concursal, haciendo referencia al caso Celsa como un precedente relevante en la jurisdicción. Thery señaló el cambio de un sistema pro-deudor a uno pro-acreedor en España y la legitimidad de la adaptación de la directiva.

Uno de los momentos destacados fue la intervención de Juana Pulgar, quien resaltó la ardua tarea de coordinación en la reforma de la Ley Concursal. Pulgar destacó la complejidad de impulsar el proceso legislativo y la importancia de buscar consensos en medio de múltiples intereses en conflicto, subrayando la necesidad de acercamiento a las consultas públicas.

La jornada concluyó con importantes reflexiones sobre la Ley 16/2022, su aplicación, efectos prácticos y posibles actualizaciones, brindando a los asistentes una visión integral de los desafíos y oportunidades en el panorama jurídico actual.
