La Sección Ítalo-Española y la Sección de Protección de Datos y Big Data del ICAM organizaron ayer una jornada conjunta bajo el título «Protección de datos personales: diferencias regulatorias entre España e Italia y su cumplimiento». A través de tres ponencias, la jornada sobre protección de datos personales permitió explorar las diferencias regulatorias entre España e Italia a través del análisis de las peculiaridades propias de cada país dentro del marco de la Unión Europea, donde “la armonización buscada por el reglamento a veces resulta en divergencias sustanciales”, tal y como señaló Javier Puyol Montier, Presidente de la Sección de Protección de Datos y Big Data del ICAM.

Tras una breve bienvenida a cargo de Roberto Spinetti, Presidente de la Sección Italo-Española del ICAM, Javier Puyol Monter introdujo la materia apelando a la “necesaria uniformidad legal en el ámbito de la protección de datos con el objetivo de proporcionar un marco legal coherente y uniforme que las empresas y organizaciones tienen que seguir”.

La primera de las mesas redondas aportó un enfoque general sobre Protección de Datos Personales, definiendo conceptos clave y delimitando el ámbito de aplicación. Además, los ponentes analizaron los derechos de los interesados, incluyendo el periodo de bloqueo según el artículo 32 de la LOPDGDD.

Posteriormente, María Suárez, socia de Privacy y Propiedad Intelectual en Andersen y profesora en los másters de Propiedad Intelectual y Nuevas Tecnologías de ICADE y la Universidad Carlos III; y Nicolò Megliorini, Delegado de Protección de Datos certificado bajo el esquema AEPD-DPD y Responsable del departamento legal del Grupo BeDisruptive, expusieron una serie de casos concretos relativos a las diferencias regulatorias, analizando aspectos como el nombramiento del administrador de sistemas, la designación de personas autorizadas según el artículo 29 del RGPD y la gestión de metadatos.

La parte final de la jornada, a cargo del propio Nicolò Megliorini y Giuseppe Campana, abogado colegiado en el Colegio de Abogados de Roma y socio fundador del Bufete C&L, estuvo dedicada a la exposición de una serie de consejos prácticos para la redacción de actas de nombramiento o designación, que permitan garantizar el cumplimiento normativo en los casos mencionados anteriormente.

A través de este programa de paneles, el evento proporcionó una oportunidad para contrastar y comprender de manera comparativa las legislaciones española e italiana en materia de protección de datos personales. Se destacó cómo, a pesar de los esfuerzos por la armonización, cada país presenta sus propias particularidades que afectan la aplicación práctica del marco regulatorio europeo.
